What happens if UE do not support TM4, but cell setting fixed TM4?

I dont know, because it say TM4 depend on UE support
But I think commercial UE already support
The UE shall support Transmission Modes: TM1,TM2, TM3 and TM4 according to 3GPP Rel-8.

So all UE support R8.
